Personal Injury
A personal injury occurs as a result of a tortious act. A tortious act occurs when the tortfeasor (the wrongdoer) injures a person. Some personal injuries occur as a result of intentional acts which include battery and assault, for example. One of the most common types of personal injury torts is common law negligence. If someone is negligent, they have breached a duty that caused another person harm, or “damages.” Regardless of the type of personal injury, there are specific deadlines called statutes of limitations that an injured person must observe. If the statute of limitations is not observed, the injured party may not be able to recover his or her damages. Time may not be on your side. Criminal Law
Criminal law is the body of law that defines crimes, regulates the punishment of crimes, and fixes modes of treatment and penalties for convicted persons. To be proven guilty, the prosecuting attorney must prove each element of the crime “beyond a reasonable doubt.” Many people are familiar with that phrase, but few understand the challenges associated with meeting that burden and defending against the prosecutor meeting that burden. Real Property Litigation
Real property or real estate litigation encompasses a wide variety of matters arising out of or related to interests in real property. Real estate litigation sometimes involves a subset of contract law because basic real estate transactions involve contracts. Disputes sometimes arise because a contract may be open to interpretation or one of the parties may fail to perform his or her obligations. Furthermore, real property disputes may have to do with damage to the property or the land. In those cases, the tort theory of negligence, as discussed above, may come into the picture.
